Greer's Gears Driving School.

Introduction.

The contract for driving tuition is solely between you and your instructor who is either Chris Greer trading as Greer's Gears Driving School or a self-employed franchisee of Greer's Gears Driving School.

These terms and conditions apply to that contract.

All driving lessons and courses are operated by Greer's Gears Driving School, whose registered address is 7 Dalmore Place, Irvine, Scotland KA11 2BS ("Greer's Gears Driving School" / "We"). The "Pupil(s)" / "You" is / are the person(s) confirmed on the course confirmation letter.

"Force majeure" is any situation beyond the control of your instructor or Greer's Gears Driving School, which can be, but is not limited to, war, terrorist activity, natural disaster, civil strife, adverse weather, road conditions, accident and / or mechanical breakdown inclusive of punctures,  fire, bureaucratic obstacles and  changes in schedules by the Driver and Vehicle Standards Agency ("DVSA").

Greer's Gears Driving School reserves the right to decline any booking at their discretion. The Pupils(s) are required to sign a copy of the terms and conditions and a release and waiver form.

Variation of the terms of this contract is only valid if done so in writing and signed by both the Pupil(s) and an authorised representative of Greer's Gears Driving School. The contract and all matters arising from it are subject to Scottish law and the exclusive jurisdiction of the Scottish Courts. In the event that any of the provisions of this contract shall be determined by any Court to be invalid, unlawful or unenforceable to any extent then such provision shall to that extent be severed from the remaining provisions of the contract, which shall continue to be valid and enforceable.

Driving is potentially hazardous. You should be aware of this. We will take all reasonable precautions to ensure your safety whilst you are learning with us, however you should also do your best to prevent injury or accident to yourself or others. Do as your instructor tells you. If you are unsure about anything get it clarified before continuing driving.

General Rules and Information General Conduct.

Your instructor is bound by a professional code of conduct, which ensures that all Greer's Gears Driving School staff / instructors will be polite, tidy and will not smoke in the car while giving tuition. They will behave in a correct, professional and ethical manner at all times.

All efforts will be made to avoid physical contact with clients. However, this is not always possible in the event of any physical intervention (e.g.taking hold of the steering wheel to avoid a collision) taking place.

Greer's Gears Driving School aims to provide you with the highest quality tuition at competitive prices in accordance with the Driving and Vehicle Standards Agency requirements and professional Code of Conduct.

Instructors are self-employed and are licensed to use training materials provided by Greer's Gears Driving School.

For the purposes of your driving lessons you will be expected to complete your arranged lessons whilst NOT under the influence of alcohol or drugs. Prescribed medications that may impact on your ability to drive should be disclosed to your instructor who will make an assessment on your ability to drive before any lesson in started.

Qualifications.

The Driver and Vehicle Standards Agency (DVSA), part of the Department for the Environment, Transport and Regions, is the agency that examines, licences and controls the standards of all driving instructors in the UK. Your Driving Instructor is registered with the Driving Standards Agency (DSA) and is approved by them to display the Approved Driving Instructor (ADI) badge on his/her car in addition they are trained in the correct way to deliver lessons in accordance with the standard expected by Greer's Gears Driving School.

Tuition vehicles.

Your instructor gives your tuition in his/her car, which is properly insured for this purpose and for use in driving tests. The car is fitted with dual controls, is correctly maintained and should be clean and tidy at all times.

Greer's Gears Driving School Training Package.

We strongly believe that in order to learn effectively all lessons must be structured to suit each individual needs. It is for this reason that we offer a package of training to minimise costs whilst ensuring our students receive the highest quality tuition. Our students will be provided with free access to online resources to assist in the learning process. Access to these resources will terminate on successful completion of your course and passing of the UK Driving Test. Theory Test preparation is included within the learning resource package.

Your Legal Requirements.

At the start of your first lesson your instructor will ask you to sign a form stating that you have read and understood the 'Terms of Business, General Rules and Information.' You agree allow Greer's Gears Driving School to check your provisional driving licence and carry out an eyesight check (ensuring you can read a car registration plate at a minimum of 20.5 metres old style number plate or 20m for the new style). Your attention is also drawn to your responsibilities under the Road Traffic Act concerning the use of alcohol and drugs. Please ensure you present yourself in a fit and proper state to drive.

Progress Reports.

Greer's Gears Driving School will tailor your lessons to your learning needs during each lesson. All lessons systematically work through all training phases and your progress is recorded. Feedback at each stage will ensure that you are fully aware of your strengths and weaknesses.

Bookings.

Initial enquiries and bookings are either made via Greer's Gears Driving School website, contact form or through Head Office on mobile 07983 689500 (Monday to Friday 9:00am to 5.00pm and Saturday 10:00am - 2:00pm). An answering machine service is available out with these hours. Greer's Gears Driving School will call to make a booking within 24 hours of your initial enquiry to arrange a suitable time for your first lesson. Thereafter bookings will be made directly with your instructor at the end of each lesson. It is in your best interest to book lessons 3 or 4 weeks in advance to avoid the disappointment of the times most convenient to you being booked by other pupils.

Contacting Your Instructor.

Your instructor can be contacted directly using the mobile phone number he/she will issue. If you cannot find the number you can contact the office or email using this address: enquiries@greersgears.co.uk

Lesson Start Times.

Your instructor will make every effort to meet you at the start time and location booked for your lesson. However, this is dependent upon traffic conditions. You are asked to be prepared to start 10 minutes earlier or later than the time booked. Irrespective of the time of arrival of your driving Instructor, the full lesson time will be given. If this is not possible then remainder allocated times can be rolled over to be included during the next arranged lesson. We ask for flexibility which will be reciprocated when required.

Cancellations.

Please give our office and/or your instructor as much notice as possible should you have to cancel or change a lesson. As your instructor is self-employed, should they be unable to re-book a lesson with another pupil, they personally lose income. You will be charged for a cancelled lesson if less than 48 hours notice is given. Exceptional circumstances will be considered at the instructor's discretion.

Theory and Driving Tests (Car).

Theory and practical tests can be booked via Greer's Gears Driving School and in some cases your instructor directly during a lesson. Please make all bookings in the knowledge of your instructor so as to prevent booking conflicts.

An assessment of your readiness and preparation to undertake any test is in no way a guarantee of a test pass. Your instructor cannot be held accountable for your performance during the conduction of an externally assessed test procedure.

Driving test bookings take preference over lessons. DVSA have the ability to cancel and rebook tests without prior notice so if your lesson time needs to be changed, your instructor will let you know as soon as possible. You will be advised of the details regarding test bookings and what to do in the event that any booking is cancelled.

Your instructor will reserve a warm-up lesson, duration variable, and 1 hour for your test. Tests and bookings are carried out by DVSA staff who are not affiliated in any way top Greer's Gears Driving School, thus your instructor cannot be held responsible for any cancellations or postponements. We will help you to reclaim any out of pocket expenses you have lost as a result of cancellations.

Prices.

The prices shown on our website are for Greer's Gears Driving School. We continually assess and evaluate the standards and performance of our instructors in an effort to maintain the highest standards and licensing authorised by the DVSA to conduct lessons. Your instructor has been trained to a very high standard by Greer's Gears Driving School approved driving instructor training.

Payments.

Individual lesson payments should be made direct to your instructor. Advance payments for courses can be made to your Instructor (please ensure you obtain and retain your receipt for your own records). Payments can also be taken on behalf of an instructor direct to Greer's Gears Driving School. Please note that your instructor is self-employed and operates under a Greer's Gears Driving School franchise agreement. Any problems regarding payments should be made directly to your instructor and not our office unless initial attempts at resolution have failed or cannot be secured. Greer's Gears Driving School operates only as agent for our instructors.

Please note any deposit or any subsequent training fees paid are not refundable in the event that you decide to cancel the training once the booking has been accepted by your allocated instructor. At this point a binding agreement is made between yourself and the allocated instructor. This does not in any way affect your statutory rights to be provided with the goods and services you have bought. Please also note that a full refund will be given if Greer's Gears Driving School or your allocated instructor is unable to meet any special requirements noted.

Customer Care Payment Protection Scheme.

When / if you pay money direct to Greer's Gears Driving School it will be held in the Greer's Gears Driving School Instructors' clients holding account. This money is being held on behalf of you and your instructor. Your instructor will be paid at the start of any tuition in advance of the tuition provided.

To ensure that Greer's Gears instructors provide driving tuition services to the exacting high standards required, you agree that management staff of Greer's Gears Driving School can act as an arbitrator and withhold any money in the clients account in the event of a complaint. Only when this matter is resolved to the satisfaction of Greer's Gears Driving School Director will payment be passed on or refunded as the case may be. In this way, the standards of the franchise can be maintained and you can be assured that you get what you pay for. Please note if you book directly with your instructor this scheme is not operated unless specifically requested and agreed by your  instructor and confirmed by Greer's Gears Driving School.

Lesson Postponement.

You are requested to provide as mush notice as is possible, minimum requirement being 48 hours should you need to cancel / amend arranged appointments. Provided your instructor can easily obtain additional work for any individual lessons postponed no penalty will be incurred. If this is not possible the full training fee for the period in question may, at the total discretion of your instructor, be lost or charged. Your instructor reserves the right to postpone lessons if he or she feels unwell or that the weather or road conditions are unsuitable or dangerous. Your instructor cannot be held responsible for any costs incurred as a result of him or her having to postpone any lessons, for whatever reason.

Young Driver Experience Sessions  - General Terms & Conditions Summary.

  • We reserve the right to refuse instruction to anyone who turns up under the influence of alcohol, drugs or in an unfit state to drive.
  • No refund or re-schedule will be offered.
  • All tuition sessions must be paid for at the time of booking.
  • Educational road safety / group presentations are priced individually and must be paid before sessions begin and, once the booking is confirmed, cannot be cancelled.
  • All bookings must be made directly with the office by telephone
  • Greer's Gears Young Driver experience days are booked subject to availability. In the event of unforeseen circumstances, we reserve the right to change times or dates booked.
  • We will endeavour to meet specific requests but we cannot guarantee that a student will have the same instructor for all advertised events.
  • Late Arrivals: Greer's Gears Young Driver Sessions runs to a tight schedule. Arriving 15 minutes late or more for an appointment may result in a lesson being forfeited - Latecomers will not receive extra time at the end of their allotted booking

Young Driver Experience Cancellations.

  • Should you require to cancel or re-schedule your booking, five clear days' notice must be given or a loss of fee will be incurred
  • We are unable to refund or re-schedule in the event that you do not give the required notice or if any kind of illness or accident prevents your attendance
  • Failure to keep a booking without prior notification will automatically result in loss of fee

Greer's Gears Gift Vouchers.

  • Greer's Gears Driving School vouchers are valid for twelve months from date of purchase.
  • Vouchers can only be used for lessons with Greer's Gears Driving School.
  • It is not possible to transfer vouchers or lesson/s to another person.
  • We are unable to redeem for cash.

Complaints Process.

This is a contract between yourself and your Driving Instructor. Should you have any complaints or are not happy in any way with your training, or any other part of our service, you should initially try to resolve these directly with your instructor.

If you booked your course or lessons through Greer's Gears Driving School office then you may contact the person who arranged your training in the first place for advice and help by phone or email.

If you booked directly with any Greer's Gears Driving School Instructor you will need to put your complaint in writing to Chris Greer, Greer's Gears Driving School, 7 Dalmore Place, Irvine, KA11 2BS or by Email. Should your instructor or Greer's Gears Driving School be unable to resolve the issue and if you are still unsatisfied with the outcome, your complaint should be made in writing direct to the Driver and Vehicle Standards Agency or Trading Standards. The address will be available from your driving instructor, our office or online.

Greer's Gears Driving School reserves the right to change prices, details of products and services (and any offers) posted online without notice. All products and services are subject to availability and we give no guarantee in this regard. The provision of details of products and services on this website are not, and should not be construed as, an offer to sell or buy such products or services. Greer's Gears Driving School may accept or reject your offer at it's sole discretion.

Your Statutory Rights.

Nothing in these terms and conditions will reduce your statutory rights relating to faulty or mis-selling of goods or services provided. Greer's Gears Instructors have a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. Similarly, any goods supplied by Greer's Gears Driving School must be fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.
